Terms and Conditions
These are the terms and conditions of engagement for photography services provided by Belinda Bullock Photography. They apply alongside any specific written agreement we make for your booking.
1. Clear instructions
All instructions must be in writing. That way, we’re both clear on what’s expected and agreed.
2. Copyright and usage
I retain copyright of all images. You receive a licence for the agreed purposes, and I keep the right to use images for business promotion unless we agree otherwise.
3. When you can use the images
You can start using the photos once full payment is made, unless we agree otherwise in writing.
4. Assigning copyright
Where full copyright transfers to you (rather than a usage licence), this happens on complete payment. You must secure any necessary model and location permissions, and I retain promotional rights.
5. Changes and cancellations
Please tell me promptly of any changes to the brief, location or schedule, as significant changes may affect timing, availability or costs.
6. Attendance at the shoot
If you’re attending the shoot or sending a representative, their approval of shots counts as final unless agreed otherwise.
7. Your responsibility to back up files
Once I’ve delivered the final images, it’s your job to store and back them up.
8. Your privacy
Personal information is collected and stored to facilitate the work and promote services. See the Privacy Policy for details.
9. Payment
Payment terms are listed in our agreement or invoice. If not specified, full payment is due before images are delivered.
10. Costs
You’ll cover any costs related to the shoot (e.g. props, locations, assistants).
11. Urgent jobs
I can’t be held responsible for additional costs or delays when urgent jobs experience complications without time for reshoots.
12. Changes to quotes
Estimates may change if substantial time passes before booking confirmation.
13. Overdue payments
If payment is late, I can charge 25% interest and recover any legal or collection costs.
14. Refunds
Unless otherwise agreed, fees are non-refundable once the shoot has taken place or editing has begun.
15. Postponements
You may reschedule once without additional charge. Further postponements trigger full fee payment to account for lost booking dates.
16. Cancellations
Cancellations made without sufficient notice may incur fees covering lost time and preparation expenses.
17. Image archiving
I may retain copies temporarily but assume no long-term storage responsibility unless specifically agreed.
18. Contractors (e.g. models)
You assume responsibility for self-booked contractors. When I book contractors as your agent, you cover all associated costs.
19. Client property
Items left with me are at your risk. Storage charges may apply, and unclaimed items after six months can be disposed of.
20. Confidential information
Please identify any confidential materials, which I will handle carefully.
21. Your legal responsibility
You agree to cover any legal costs or claims that arise from you breaching these terms, using illegal content, or using someone else’s intellectual property.
22. Colour matching
I’m not liable for colour variations beyond my control, such as display differences or material fading.
23. Image quality
Technically unusable images result in no charge. Client approval during shoots constitutes final acceptance.
24. Consumer rights
Consumer rights apply to personal purchases; business purchases fall under these terms instead.
25. Limits to my liability
I’m not liable for delays, lost profits, indirect losses, or mistakes stemming from unclear verbal instructions.
26. Maximum liability
If I’m at fault, the most I’ll pay is the total amount you paid me for the job.
27. Health and safety
You are responsible for your own safety and for complying with shoot instructions.
28. Force majeure
Unforeseeable circumstances like weather or illness exempt both parties from liability for delays or non-delivery.
29. Disputes
Both parties commit to good-faith resolution before pursuing legal action.
30. Conflicts
Written agreements take precedence over these standard terms if conflicts arise.
31. NZ law
These terms follow New Zealand law. Any disputes will be handled in a New Zealand court.
32. Entire agreement
These terms and any specific written agreement constitute the complete arrangement.
33. Definitions
- Client: the booking party
- Photographer: Belinda Bullock and her team
- Photographic works: all created images and videos
- Licence: agreed usage rights
- Booking / order: the requested shoot or service
- Advertiser: the final image end-user, if different from the client
- Job-related costs: shoot-associated expenses
- Agreement: the complete written arrangement including these terms
